How to Become a Teacher in Kansas

With approximately 473,000 public school students. Kansas has plenty of work to go around for educators. The Sunflower State has seen roughly a $10,000 salary increase for classroom teachers in the last decade alone. Becoming a teacher in Kansas is a process much like those found in other states. For instance, as in other states, a Kansas certified teacher must order, complete, and mail back a fingerprint card. a law that has been in effect since August 2011.

Education Requirements

To obtain a Kansas teacher certification, students must complete a teacher preparation program in the area they want to teach. Those interested in teaching pre-K through elementary school, for example, need to complete a program that focuses on elementary education. Future middle and high school teachers, on the other hand, must first receive a degree in the subject matter they wish to teach, like math or science, before completing a teacher preparation program approved by the Kansas State Board of Education.

Kansas Teaching Certification

All Kansas educators need a state-issued certification to teach. To qualify for licensure, Kansas candidates must have a bachelor s degree, complete an approved teacher preparation program, pass the required tests for their licensure area, and submit all necessary licensure forms and fees. Kansas also offers an alternative teacher certification program called Restricted Teaching License Alternative Pathway. which provides accelerated training to college graduates and professionals seeking a career change.

To obtain an initial teaching license in Kansas, all candidates must complete a content knowledge assessment in each subject or endorsement area you plan to teach, as well as a pedagogy or teaching skills assessment called the Principles of Learning and Teaching (PLT). Kansas educators must receive a passing score from one of the four PLT tests and the content assessment to obtain licensure.

State Certification Reciprocity

All out-of-state applicants who want to teach in Kansas must hold a valid full or standard out-of-state license or certificate and have completed a state-approved teacher preparation program. To use piering, the foundation repair professional will need to dig many feet into the ground to solidify the pier which is then placed under your foundation and raised with hydraulics to lift the foundation back into place and stabilize it for the future. This repair method requires the use of multiple piers placed at different points under the foundation.

Slabjacking is a process whereby a grout mixture is pumped into the space under the concrete foundation and floats the foundation back to its original position. A professional will be able to assess which repair method is best suited for your foundation issues.

Medical Malpractice: When Can Patients Sue a Hospital for Negligence?

If you are injured when receiving medical treatment in a hospital, can you sue the hospital for negligence or medical malpractice? Though hospitals are often on the hook for incompetent care provided by employees like nurses and medical technicians, they often are not responsible for a doctor’s medical malpractice.

Here’s a primer on when a hospital is, and is not, responsible for medical malpractice committed by employees, doctors, anesthesiologists, and other care providers.

Hospitals Are Liable for Employee Actions

If someone is an employee of a hospital, the hospital is typically responsible (liable) if that employee hurts a patient by acting incompetently. In other words, if the employee is negligent (is not reasonably cautious when treating or dealing with a patient), the hospital will usually be on the hook for any resulting injuries to the patient. (Keep in mind that not every mistake or unfortunate event that happens in a hospital rises to the level of negligence. Typically, nurses, medical technicians, and support staff are hospital employees. As long as the employee was doing something job-related when he or she caused an injury to a patient, the patient can usually sue the hospital for resulting damages. For example, if a registered nurse (R.N.) employed by the hospital injects the wrong medication into an IV “push,” and the patient ends up suffering harm as a result, then the hospital could probably be considered liable for the R.N.’s mistake.

However, if a doctor makes a mistake and injures a patient while working in the hospital, the hospital will not be liable for the doctor’s mistake unless the doctor is an employee (which is unlikely — see below).

Also, if a hospital employee commits malpractice while under a doctor’s supervision, the patient can sue the doctor, but the hospital may be off the hook. Whether an employee is under the supervision of the doctor when the misdeed occurs depends on:

whether the doctor was present, and

whether the doctor had control to prevent the employee’s negligence.

For example, a surgeon may be liable if an attending nurse miscounts the surgical sponges, leading the surgeon to leave a sponge in the patient. (To learn more about this situation, read Nolo’s article Nursing Malpractice ) .

Is the Doctor an Employee of the Hospital?

This is the critical question when figuring out whether the hospital itself can be sued when a doctor provides sub-standard care and ends up causing harm to a patient.

Whether a doctor is a hospital employee depends on the nature of his or her relationship with the facility. Though some doctors are hospital employees, most doctors are not. Non-employee doctors are usually classified as “independent contractors” in the eyes of the law, which means that the hospital cannot be held responsible for the doctor’s medical malpractice, even if the malpractice happened at the facility, and the doctor is officially affiliated with the facility.

A doctor is more likely to be an employee (rather than an independent contractor) if:

  • the hospital controls the doctor’s working hours and vacation time, or
  • the hospital sets the fees the doctor can charge.

Exceptions: When Hospitals Are Liable for Non-Employee Doctors’ Actions

Even if a hospital would generally not be liable for an independent contractor doctor’s malpractice, a hospital may be held responsible in certain situations.

Hospital Appeared to be the Doctor’s Employer

If the hospital does not make it clear to a patient that the doctor is not an employee, the patient can sue the hospital for the doctor’s malpractice. Hospitals attempt to avoid this problem by informing patients in the admission forms that the doctor is not a hospital employee.

The situation is different for patients injured in an emergency room. Usually, the hospital does not have an opportunity to inform emergency room patients that a doctor is not an employee. This means that ER patients can often sue the hospital for a doctor’s medical malpractice. There are also a few states that say a hospital can be sued for emergency room malpractice regardless of what the patient believed or was told. Hospital Keeps an Incompetent Doctor on Staff

A number of states hold the hospital responsible if it gives staff privileges to an incompetent or dangerous doctor, even if the doctor is an independent contractor. The hospital is also responsible if it should have known that a previously safe doctor had become incompetent or dangerous. For example, if a doctor becomes severely addicted to drugs and the hospital management knew about it, or it was so obvious they should have known about it, a patient injured by that doctor can probably sue the hospital.

Luke Short, Tombstone, Arizona Territory Feb. 25, 1881

Almost all historians have depicted Luke Short as a citified dandy gambler, probably because so little was known about his early years, but Wayne Short, Luke’s great-nephew has changed that view with his new biography.

Luke, who left home at thirteen after cutting up the school bully, indeed, was fastidious in his dress, but for six years he was a thirty dollar-a-month cowhand on the dangerous longhorn drives from Texas to the Kansas rail towns. He hunted buffalo for their hides during the heydays of 1874-75, scouted and rode dispatch for General Crook and Major Thornburgh during the Sioux and Cheyenne uprising of 1876-78, traded with the Sioux and Cheyenne around Camp Robinson in northwestern Nebraska and finally was arrested for trading whiskey to the Indians for buffalo robes.

He escaped from the army escort which was taking him to Omaha on the train and made his way to Denver and never worked again except as a high rolling professional gambler in the cowtowns and mining camps all over the west. He was no slouch with a six-shooter, either. This enigmatic man was close friends with Bat Masterson and Wyatt Earp and shot it out with some of the deadliest gunmen of that era.

Wayne Short comes from a long line of pioneering people. In 1859, his great grandfather crowded his large family into ox-drawn wagons and headed West. They finally settled on the Red River in Texas where they farmed and fought Comanches and Kiowas. Most of this indomitable little man’s sons grew to be cattlemen, but one, Luke Short, sought out the boomtowns of the West and became one of the most well-known gamblers and gunfighters of that era.

The next two generations of Shorts turned west and north seeking new country and Wayne Short was born in Nadaburg, Arizona seventy years ago. He served in the Navy’s amphibious forces during World War II and made the invasions of Iwo Jima, Okinawa, and the Philippines. He and his parents and two brothers moved to an isolated island in Southeastern Alaska in 1946 where Wayne learned to fish commercially and live off the land. Mr. Short has worked as a trapper, bounty hunter, cannery tender skipper, carpenter, shipwright, steam engineer, and commercial fisherman.

In 1954, Wayne brought his bride, Barbara, north to share their isolated life. They now have five sons and five grandchildren. Wayne has been writing and selling short stories, articles, and books for thirty-five years. Many of his stories tell of the remarkable but true stories of the adventures he and his family shared in Alaska. His latest dream was to research and write about his great uncle, Luke Short, the notorious Arizona Territory gambler and gunfighter who was a friend of men like Wyatt Earp and Bat Masterson.
