CEO of Orange County Mortgage Lender Sentenced to 41 Months in Federal Prison in Ponzi Scheme

SANTA ANA, CA The CEO of an Orange County-based mortgage banking and financial services firm was sentenced today to 41 months in federal prison for operating a Ponzi scheme that collected more than $6.7 million from more than two dozen victims, announced Andr Birotte, Jr. the United States Attorney in Los Angeles, and Bill L. Lewis, the Assistant Director in Charge of the FBI s Los Angeles Field Office.

David Lee Hardin, Jr. 59, of Coto De Caza, who is the CEO and majority shareholder of a group of companies including Covenant Mortgage, Covenant Marketing, Covenant Debt Solutions, Covenant Insurance, and HRE Mortgage, was sentenced by United States District Judge James V. Selna. In addition to the prison term, Judge Selna ordered Hardin to pay $1.5 million in restitution. Judge Selna noted that such investment fraud schemes are prevalent in the Orange County area and that Mr. Hardin s sentence was meant to serve as a deterrent to others.

Hardin pleaded guilty in March 2013 to mail fraud, admitting that his victims suffered losses of approximately $1.5 million.

From April 2007 through July 2010, Hardin solicited investments in a side venture related to his companies mortgage business. The investments were structured as loans to Hardin s companies at fixed rates of interest. Hardin told the investors that their funds would be used to finance a home building project, to originate mortgages, and to fund his debt settlement business and that returns would be generated through home sales and fees from mortgage originations and debt settlement services. In reality, Hardin used a large percentage of the funds to make purported interest payments to earlier rounds of investors, in the typical pattern of a Ponzi scheme. He used other funds for personal expenses, including rent and car payments. Still other funds were used for operational costs of Hardin s other businesses, including employee salaries and operating costs.

The criminal case against Hardin is the result of an investigation by the Federal Bureau of Investigation.

    Timeline

    • 1763 Earliest known date of existence

    Charles Moore received a grant for 550 acres along the Tyger River by King George III. He later received additional grants bringing his total acreage to about 3,000 (1 ).

  • 1765 Charles Moore built a house on the property.

    Charles and his wife Mary raised their ten children on the plantation.

  • 1767 Margaret Kathryn Moore (Kate). the first child of Charles and Mary Moore, married General Andrew Barry at the age of 15. During the Revolutionary War Kate helped her husband by spying on Tory troops, chasing them away from her home, and gathering men to help her husband fight. She was considered quite a heroine.

  • 1770 Charles Moore built a school building and operated the first school in Spartanburg County. Rocky Spring Academy was open until 1850.

  • 1961 The house, along with eight acres, was given to the Spartanburg County Foundation in a special trust with the Spartanburg County Historical Association as the sponsor for the trust. Up to this time, descendants of Charles and Mary Moore had owned the house and property (1 ).

    Majors

    Albright’s ADP curriculum features an accelerated seminar format with intense use of the Internet as well as additional computer technology. Interaction between students is emphasized and much of this collaboration involves applied group activities.

    While traditional classes meet 40-44 hours per semester, Albright’s ADP courses meet for four hours per evening for five to seven weeks. Remaining class time is fulfilled by a combination of Internet usage and independent study.

    Through a special partnership with Reading Area Community College, Delaware County Community College, Harrisburg Area Community College, Lehigh Carbon Community College, Montgomery County Community College, Northampton Community College, and Warren County Community College, most associate degrees (A.A. or A.S.) from these colleges transfer fully to Albright ADP (and acceptance is automatic if all Albright transfer admissions criteria are met.) Albright College offers a $2,500-3,200 Partner Scholarship based on GPA to graduates of these colleges. (Any applicant with an Associates Degree is eligible for a $2,500 scholarship.)

    ADP offers bachelor’s degrees in:

    Accounting: The accelerated program in accounting prepares students for careers in public and private accounting and in obtaining professional certifications. This major also provides students with a strong foundation for entering a graduate school program.

    Business Administration: The accelerated program in business administration prepares students for a wide variety of careers in finance, banking, marketing and management. This major also provides students with a strong foundation for entering a graduate school program.

    Crime & Justice: The accelerated program in crime and justice involves an analysis of criminal deviance and its roots, plus an in-depth understanding of our criminal justice system’s successes and failures.     – View and download monthly payments (this replaces HAPCheck)

    – Request to update your contact information

    – Ability to download 1099’s at the end of calendar year 2016
